Terms of Service

Introduction

These Terms of Service (“Terms”) govern your use of Freebuff and Codebuff, including the websites, apps, and other services operated by Freebuff, Inc. (“Company”, “we”, “our”, or “us”) (“Service”). Our Privacy Policy explains how we collect, use, retain, and disclose information.

By accessing or using Service, you agree to these Terms. If you do not agree or cannot comply, you may not use Service. Questions may be sent to support@freebuff.com.

Communications

We may send you transactional or service-related communications. Subject to your choices and applicable law, we may also send marketing or promotional communications. You may opt out of marketing communications by following the unsubscribe link or by emailing support@freebuff.com.

Payments

You agree to provide accurate information and pay the fees shown at purchase. Payments are processed by third-party payment processors, and we may refuse or cancel a transaction if we suspect fraud or unauthorized or illegal activity. You may not circumvent payment or eligibility requirements by fraudulently exploiting discounts, promotions, referrals, regional pricing, or eligibility programs, and you remain responsible for any resulting amounts owed.

Subscriptions

We may offer paid plans that add usage on top of the free service. Plans renew monthly or annually at the billing option and price shown at purchase, and annual plans are paid upfront. A discounted first month, where offered, applies once per account to monthly billing only.

Each plan includes usage allowances, which may be limited by day, model, or cost, as shown on the plan page in your account settings. When an allowance runs out, plan usage pauses until it resets; free usage is unaffected. Certain models may be unavailable during peak-demand hours.

All plan limits, prices, and included models are subject to change. Changes to recurring prices take effect at your next renewal; we may adjust usage limits and model availability at any time to reflect provider capacity and cost. Material changes will be reflected on the plan management page.

You may cancel at any time from your account settings. Cancellation of a monthly plan takes effect immediately. Cancelling an annual plan stops its next renewal, and access continues through the end of the paid annual term. No prorated refund is provided for the remainder of the current billing period. Usage allowances continue to refresh on their stated daily and monthly schedules regardless of billing interval. Supported downgrades take effect at the next renewal. Initiating a payment dispute or chargeback for inference that has already been consumed may result in immediate termination of the subscription and suspension of the account.

Freebucks and Rewards

Freebucks are credits for using Service. They have no cash value and cannot be transferred, sold, or exchanged for money. Purchased Freebucks expire one year after purchase, and daily allowances reset each day. We may change what Freebucks can be used for and what models and features cost in Freebucks.

Rewards, such as Earn, referral, streak, and survey rewards, are subject to the eligibility rules shown with them. We may withhold or reverse Freebucks or rewards credited in error or obtained through abuse or a breach of these Terms.

Free Access and Human Use

Our free usage limits and model eligibility are intended to apply to each person, not to each account. Free access may be supported by advertising and is provided for individual, human-directed use through the normal interfaces and intended functionality of our products. Unless we give you written permission, you may not:

• Create, control, or operate more than one Freebuff account. Each person may hold one free account, which may be used across our products. Duplicate, alternate, secondary, or shared accounts are not allowed, and you may not let another person use your account.
• Resell, rent, proxy, relay, or otherwise provide access to Service, or to the free access it offers, to other people, applications, or services, whether or not you charge for it.
• Access free AI model inference except through normal use of an official Company product that offers it. You may not call the underlying servers or endpoints directly or through scripts, custom clients, wrappers, integrations, or third-party software.
• Use a bot, script, macro, headless browser, autonomous agent, or similar automation to operate our products or submit requests. A human must initiate each session and remain actively present while it runs. Automation performed by our products after a human starts a session is allowed.
• Hide, spoof, or misrepresent your actual country or location, including by using a proxy, VPN, relay, or similar service to make your traffic appear to come from another country, in order to obtain models, features, limits, pricing, or eligibility that are not available in your actual location.

Identity Verification and Identity Lock

To keep free access to one account per person, we may require an account to verify the identity of the person using it at any time, including when it signs in, starts a session, or sends a message, and we may limit or refuse free features until it does. We may also require a phone number that is not already used by another account. Some accounts may also verify voluntarily from their account settings to get a verified badge. Verification is performed by our identity verification provider, Didit, and involves a photo of a government ID and a short selfie. We ask for your separate consent before any biometric data is processed. A verified badge does not exempt an account from these Terms.

You must verify only with your own, genuine identity. Providing a false, forged, or altered identity document, someone else's identity, or a photo or video that is not a live capture of you, or verifying (or trying to verify) an identity that is already used on another Freebuff account, is a breach of these Terms that results in the permanent suspension of every associated account, including accounts that share a device with the account involved.

When you complete verification and accept the identity-lock terms, the verified identity (your ID document and your face) is locked to that account. If the same identity is later used on any other Freebuff account, every account associated with it will be suspended permanently. The lock stays in place if you delete the account. A suspension for abuse applies to the person: if an account verified with an identity is suspended for how it was used, every other account verified with the same identity, including later ones, is suspended too.

To detect duplicate, shared, and automated accounts, we use device and network signals, including information from a third-party device-identification provider (Fingerprint), browser and application identifiers, and the networks you connect from, as described in our Privacy Policy. We may limit, require verification of, or suspend accounts based on these signals.

AI Output and Actions

AI output may be false, insecure, incomplete, or infringing, and may introduce vulnerabilities. AI agents act autonomously and may take actions you did not request or expect, including executing commands, deleting or corrupting data, interacting with external systems, and accessing files, credentials, environment variables, or other data available to them, including outside your project, and including that data in requests to model providers. Malicious repository content or prompt injection may affect output or actions. We cannot guarantee what an agent will do. You are responsible for the environment where you run agents and the access you give them. Keep backups, test and review output, and maintain human supervision. Output is not legal, medical, financial, or other professional advice.

Prohibited Uses

You may use Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Violate any law or another person's rights, including intellectual property rights.
• Exploit or harm minors.
• Send spam, commit fraud, make threats, or impersonate Company or anyone else.
• Harm, overload, disrupt, or gain unauthorized access to Service, its users, or connected systems, including through malware or denial-of-service attacks.
• Scrape or copy material from Service through automated means without our written consent.
• Reverse engineer, decompile, or derive Service's source code or underlying components, except where law permits.
• Access, extract, expose, or distribute non-public information belonging to Company or its providers, including system prompts, proprietary source code, access credentials, or other confidential information.

To detect abuse and enforce these Terms, we may review your prompts, messages, and agent activity, using automated systems and service providers acting on our behalf, and authorized personnel may review specific content when needed. We may limit, suspend, or terminate your access based on that review. Our Privacy Policy describes this processing.

Accounts

You must be at least 18 to use Service. By using it, you represent that you are at least 18 and able to agree to these Terms. Keep your account information accurate and your sign-in secure. You are responsible for activity on your account and must tell us promptly about any unauthorized use. We may refuse service, remove content, or cancel orders at our discretion.

Intellectual Property

Ownership of Service, Content, and output is described under Content. You may not use our names, logos, or other trademarks without our prior written permission.

Copyright Complaints

We respond to notices of copyright infringement under the Digital Millennium Copyright Act (17 U.S.C. § 512). If you believe material on Service infringes your copyright, email our Copyright Agent at support@freebuff.com with the subject line “Copyright Infringement” and include:

• your physical or electronic signature, as the copyright owner or a person authorized to act for them;
• a description of the copyrighted work;
• the URL or other location on Service of the material you claim infringes it;
• your address, telephone number, and email address;
• a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; and
• a statement, under penalty of perjury, that the information in your notice is accurate and that you are the owner or authorized to act for them.

You may be liable for damages, including costs and attorneys' fees, for a notice that misrepresents infringement or is made in bad faith.

Error Reporting and Feedback

You may send error reports, suggestions, ideas, or other feedback (“Feedback”) to support@freebuff.com. Do not include confidential or proprietary information in Feedback. You grant Company a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, and sublicensable license to use, modify, publish, and commercialize Feedback without restriction or compensation to you.

Links To Other Websites

Service, including ads, may link to third-party websites and services that we do not control. We are not responsible for their content, privacy practices, or offerings, and your use of them is at your own risk and subject to their terms.

Indemnification

To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless Company and its affiliates, officers, directors, employees, agents, licensors, and service providers from third-party claims, liabilities, damages, judgments, losses, costs, and reasonable attorneys' fees to the extent caused by: Content that violates law or another person's rights; your unlawful or unauthorized misuse of Service; or your material breach of these Terms.

Disclaimer Of Warranty

SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” AND YOUR USE OF IT IS AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, AND DOES NOT WARRANT THAT SERVICE, ITS CONTENT, OR ITS OUTPUT WILL BE ACCURATE, SECURE, RELIABLE, ERROR-FREE, UNINTERRUPTED, FREE OF HARMFUL COMPONENTS, OR MEET YOUR NEEDS. THIS DOES NOT AFFECT WARRANTIES THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

Limitation Of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, COMPANY AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL; OR SERVICE INTERRUPTION, UNDER ANY LEGAL THEORY, EVEN IF ADVISED THAT SUCH DAMAGES WERE POSSIBLE.

TO THE FULLEST EXTENT PERMITTED BY LAW, COMPANY'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID COMPANY FOR SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY. SOME JURISDICTIONS DO NOT ALLOW CERTAIN EXCLUSIONS OR LIMITATIONS, SO THEY MAY NOT APPLY TO YOU.

Termination

We may suspend or terminate your account or access to Service at any time, without prior notice or liability, for any reason, including a breach of these Terms. You may stop using Service or delete your account at any time. Provisions that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Governing Law and Venue

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law rules. Except where applicable law requires otherwise, the state and federal courts in San Francisco County, California have exclusive jurisdiction and venue over disputes arising from Service or these Terms, and you consent to those courts.

Changes To Service

We may change, restrict, suspend, or discontinue any part of Service at any time without notice, and we are not liable if Service is unavailable.

Amendments To Terms

We may update these Terms from time to time. We will post the updated Terms and revise the date at the top. We will provide advance notice when required by law or when a change materially affects your rights. Updated Terms take effect on the stated effective date. If you continue to use Service after that date, you agree to the updated Terms. If you do not agree, stop using Service.

General

Our failure to enforce a provision of these Terms is not a waiver of it. If a provision is held invalid or unenforceable, it will be limited to the minimum extent necessary and the rest of these Terms will remain in effect. These Terms, together with any additional terms you accept for specific features, are the entire agreement between you and us regarding Service and replace any prior agreements about it.
